(a) Proceedings involving a child alleged to be beyond control of the child’s parent, guardian or lawful custodian, or alleged to be a runaway, shall be initiated by petition. (b) A petition shall be accepted by the clerk only if it is filed by the Division of Juvenile Justice Services. (c) The petition must allege the earnest and persistent efforts by the agency, the child’s out of control behavior, the behavior or other condition that endangers the child’s welfare or the welfare of others, and the actions taken which have failed to correct the behavior. In the alternative, the allegations may be made by affidavit accompanying the petition.
