If the Commission concludes that a respondent is incompetent to act for himself or herself or to defend against the charges, it shall appoint a guardian ad litem unless the respondent has a guardian who will represent him or her. In appointing a guardian ad litem, the Commission shall consult with and consider the wishes of the respondent's immediate family. The guardian or guardian ad litem may claim and exercise any right or privilege and make any defense for the respondent with the same force and effect as if claimed, exercised, or made by the respondent, if competent, and whenever these rules provide for serving or giving notice or sending matter to the respondent, a copy of such notice or matter shall also be served upon the guardian or guardian ad litem.
