Filing fee; waiver or reduction

(a) Pursuant to section 11-a of the Court of Claims Act, the claim shall be accompanied by either a filing fee of $50 or a motion, affidavit or certification pursuant to CPLR 1101. (b) No filing fee shall be required for a third-party claim filed pursuant to section 9(9-a) of the Court of Claims Act and section 206.6(g) of this Part or for the initiation of a special proceeding. (c) An application pursuant to CPLR 1101(d) or (f) for waiver or reduction of the filing fee shall be made by completing the affidavit supplied by the clerk's office and filing the affidavit with the claim. The clerk's office will notify the claimant of the court's decision by mail.
