(a) Base Offense Level (Apply the greater): (1) If the offense was committed with intent (A) to kill or injure any per- son, or (B) to injure the mails or other property, apply §2X1.1 (At- tempt, Solicitation, or Conspiracy) in respect to the intended offense; or (2) If death resulted, apply the most analogous offense guideline from Chapter Two, Part A, Subpart 1 (Homicide). Statutory Provision: 18 U.S.C. § 1716 (felony provisions only). Commentary Background: This guideline applies only to the felony provisions of 18 U.S.C. § 1716. The Commission has not promulgated a guideline for the misdemeanor provisions of this statute.
