Cases. In each civil case sent to an appellate court upon reserved questions, certified cases and Rule 13 cases, the usual docket fee required by law to be paid in other cases shall be paid upon the filing of the papers in the court. Such docket fee shall be advanced by the party or parties designated by the trial court or judge, but in the absence of any such designation, then by the plaintiff or petitioner in the action. Recovery of costs in these cases shall be the same as in appeals with petitioner and respondent substituted for appellant and appellee where applicable. History: Source. — Former Rule 8, Sup. Ct.
