—Failure of Expert To Submit

Report If any expert fails to submit any written report of the result of any physical or mental examination con- ducted pursuant to Sections 40-17 through 40-19, the judicial authority, upon request of the party who engaged the expert, may issue an appropriate sub- poena or order pursuant to Section 40-2 or may direct that the expert’s deposition be taken pursuant to Sections 40-44 through 40-58.
