Nonparty When an order grants relief for a nonparty or may be enforced against a nonparty, the procedure for enforcing the order is the same as for a party. (Added Nov. 3, 2008.) Rules Committee Note 2008 Adoption RCFC 71 has been adopted to conform to the FRCP and to confirm the court’s authority to issue orders enforceable for or against a nonparty, a circumstance that typically arises in conjunction with the issuance of a subpoena. 89 RCFC 69, 70 and 71 TITLE IX.
