The claimant may withdraw its claims before the Arbitrator has served the written notice of acceptance of appointment. After the Arbitrator has served the written notice of acceptance of appointment, no party may withdraw from the Arbitration without the written agreement of all parties to the Arbitration. A party may unilaterally withdraw a claim or counterclaim without prejudice upon written notice to the Arbitrator and to all parties, provided that another party may, 7 within seven calendar days of service of such notice, request that the Arbitrator order the withdrawal to be with prejudice. After affording the parties the opportunity to be heard on such a request, the Arbitrator shall determine the request finally and exclusively.
