(a) By Attorney for State. The attorney for the State may file a dismissal of an indictment, information, or complaint and the prosecution shall thereupon terminate. Such dismissal may not be filed during the trial without consent of the defendant. (b) By the Court. The court, upon a finding that a defendant has successfully completed the diversion program, may dismiss the charge(s) then pending against the defendant.
