The Commission on its own motion and upon notice to the respondent, or upon application of the respondent, may order depositions on oral examination or on written interrogatories to be taken for the purpose of perpetuating testimony. Such depositions may be received in evidence at the hearing if it appears: that the witness is dead; or that the witness is outside of Rhode Island and is unwilling to attend the hearing, unless it appears that the absence of the witness was procured by the proponent of the deposition; or that the witness is unable to attend or testify because of sickness or infirmity.
