Definitions

For the purpose of these Trial Court Rules: (a) "Judicial officer" - A circuit judge. (b) "Business days" - Days other than Saturdays, Sundays, and legal holidays as set forth in W.Va. R.Civ.P. 6(a). (c) "Days," when not preceded by the adjective "business" - Calendar days counted sequentially, without regard for Saturdays, Sundays, legal holidays, or other exceptions. "Brief" - A statement of the law that supports a motion made by counsel or that opposes a motion made by another counsel. (d) "Clerk" - The circuit clerk of any county in West Virginia or any deputy thereof and, in any rule applying in magistrate court, the magistrate court clerk or deputy. (e) "Court" - circuit court. In addition, the term "court" may also mean magistrate court proceedings, when specific reference is made to magistrate court. (f) "Counsel" - Any attorney who has made an appearance for any party, or any pro se litigant. (g) "Judicial day" - any day, including any Saturday or legal holiday, other than Sunday. (h) "Memorandum of Law" - see "Brief." (i) "Pleading" - A pleading permitted by W.Va. R.Civ.P. 7. (j) "Pro Se" - representing one's self without counsel of record. (k) "TCR" - Trial Court Rule(s). (l) W.Va. R.Civ.P. - West Virginia Rules of Civil Procedure. (m) W.Va. R.Crim.P. - West Virginia Rules of Criminal Procedure. (n) W.Va. R.Evid. - West Virginia Rules of Evidence.
