Deadlines Not Changed Absent a Tolling Agreement

Effective January 1, 2025 Participation in optional early mediation under this rule does not change the deadlines for beginning a legal action as provided in any applicable statute of limitations or in any requirement for advance notice of intent to make a claim (for example, for claims against governmental units under the Indiana Tort Claims Act). Parties concerned about the expiration or running of a statute of limitations are encouraged to obtain an agreement to toll the running of the statute of limitations when considering pre-suit mediation.
