After the Arbitrator serves the written notice of acceptance of appointment as Arbitrator, the parties should avoid ex parte communications with the Arbitrator concerning the Arbitration. Any ex parte communication with the Arbitrator made necessary by exigent circumstance shall be reported promptly to all other parties. 4 Rule 11: Replacement of the Arbitrator The appointment of a new Arbitrator shall be as provided in the Arbitration Agreement; otherwise, the Court of Chancery may appoint a new Arbitrator in the event the Arbitrator becomes unable to continue as Arbitrator for any reason.
