(a) Vacancies. Upon the death, resignation, or permanent incapacitation of a member of the Commission, the chair shall notify the appointing authority and request that the vacancy, created by the death, resignation, or permanent incapacitation, be filled. The appointment of a successor shall be for the former member’s unexpired term. The successor shall, thereafter, be eligible to serve two consecutive three-year terms. (b) Disqualifications. If, for any reason, a Commission member becomes disqualified to serve on the Commission, the appointing authority shall be notified and requested to take appropriate action. If a member resigns or is removed, then the appointment of a successor shall be for the former member’s unexpired term. The successor shall, thereafter, be eligible to serve two consecutive three-year terms. (c) Conflicts of Interest and Recusals. All Commission members must abide by the Commission’s Recusal of Commission Members and Ex Officio Members Policy. 5 TOC Rule 3 (d) Compensation. Under N.C.G.S. § 138-5, members of the Commission may receive compensation for their services at the rate of fifteen dollars ($15.00) per diem for each day of service, and reimbursement of subsistence and travel at the rates allowed to State boards and commissions. Ex officio members of the Commission shall receive no compensation for their services. In the chair’s discretion, an ex officio member may be reimbursed for his or her out-of-pocket expenses necessarily incurred on behalf of the Commission and for his or her mileage, subsistence, and other travel expenses at the per diem rate established by statutes and regulations applicable to State boards and commissions.
