Commencement of action

Justice and Municipal Court Rules for Civil Traffic Infractions

Rule: 2.1

Jurisdiction: NV

Bluebook Citation: Civil_Traffic_Infractions 2.1

An action under these rules is initiated by a law enforcement officer serving a written citation on the person and filing the citation with the justice or municipal court. The citation shall be deemed to be a lawful complaint for the purpose of initiating a civil traffic infraction case. If the civil infraction citation includes information to which the truthfulness is attested as required for a complaint in a civil case or when the civil infraction citation is prepared electronically, the citation must be signed by the officer in accordance with NRS Chapter 484A . If a citation is prepared electronically and filed with a court as data, the name of the officer associated with the issuance of the citation satisfies this requirement. The citation serves as a summons to command (1) the initial appearance of the person; and (2) a response from the person as to their responsibility for the alleged violation.
