The affidavit of the treating physician shall be admissible as an exhibit of the court, with or without the appearance of the affiant, if presented in accordance with the provisions of G.L. 1956 § § 9-19-27 and9-19-39 and filed with the court ten (10) days prior to the date of the hearing. Both parties retain the right to examine or cross-examine the physician by deposition or in court, subject to the procedure set forth in W.C.C.-R.P. 2.13(B)(3).
