Barrera Executive Associate Director Management and Administration Adam Loiacono Acting Principal Legal Advisor Caleb Vitello Acting Director Suspension of the 287(g) Program Advisory Board MEMORANDUM FOR: FROM: SUBJECT: Purpose This memorandum suspends the 287(g) Program Advisory Board (PAB) and its governance structure effective immediately. This will allow U.S. Immigration and Customs Enforcement (ICE) to enter into agreements with state and local law enforcement agencies under section 287(g) of the Immigration and Nationality Act (INA) in a timely manner. Background In April 2009, ICE created the PAB to evaluate 287(g) Program applicants and submit recommendations to the ICE Director on the suitability of a state or local law enforcement agency (LEA) for participation in the 287(g) Program.

Trump issued Executive Order 14159, Protecting the American People Against Invasion, which set forth "the policy of the United States to faithfully execute the immigration laws against all inadmissible and removable aliens, particularly those aliens who threaten the safety or security of the American people." 1 In particular, the President directed that "[t]o ensure State and local law enforcement agencies across the United States can assist with the protection of the American people, the Secretary of Homeland Security shall, to the maximum extent pennitted by law, and with the consent of State or local officials as appropriate, take appropriate action, through agreements under section 287(g) of the INA (8 U.S.C. 1357(g or otherwise, to authorize State and local law enforcement officials, as the Secretary of Homeland Security detennines are qualified and appropriate, to perfonn the functions of immigration officers in relation to the investigation, apprehension, or detention of aliens in the United States under the direction and the supervision of the Secretary of Homeland Security. "2 Implementation The authority to approve or deny a State or local LEA's request to participate in the 287(g) program rests solely with the ICE Director. 287(g) approval requests should now be routed directly to the ICE Director's Office through the ICE Enforcement and Removal Operations Assistant Director for Enforcement. All other procedures for Field Office coordination with prospective State and local LEAs remain unchanged.
