Berger Executive Associate Director Homeland Security Investigations SUBJECT: Line of Succession Memorandum for the Executive Associate Director, Homeland Security Investigations Effective immediately, the Executive Associate Director (EAD), Homeland Security Investigations (HSI) Line of Succession Designation is as follows: (a) Subject to the provisions of subsections (b)-(d), below, the officials listed directly below, in the order listed, shall act as, and perform the functions and duties of, the HSI EAD in the event of the EAD’s death, resignation, inability to perform, absence, or inability to act during a disaster or catastrophic emergency until that condition ceases or a successor is appointed. 1. 2. 3.

(b) An individual serving in an acting capacity in any of the positions listed in paragraph (a) is not included in this Line of Succession. Instead, the next non-acting incumbent on the list shall serve as Acting EAD, HSI. (c) Serving as Acting EAD, HSI has no effect on the officials listed in paragraph (a), above, with respect to their full-time position’s authorities, duties, and responsibilities, except that such official cannot both recommend and approve an action. (d) Notwithstanding the provisions of this memorandum, the Director retains the discretion to designate an Acting HSI EAD.
