In cases under Immigration and Nationality Act (INA) §§ 274A, 274B, and 274C, the Administrative Law Judge’s (ALJ’s) final order becomes the final agency order 60 days after the entry of the order, unless:

  • in a case arising under INA § 274A or 274C, the Chief Administrative Hearing Officer modifies, vacates, or remands the ALJ’s final order pursuant to 28 C.F.R. § 68.54; or
  • in a case arising under INA § 274A, 274B, or 274C, the order is referred to the Attorney General pursuant to 28 C.F.R. § 68.55.
