9 FAM 305 WAIVERS .1 Types of Waivers Available (CT:VISA-1429; 12-07-2021) (Office of Origin: CA/VO) .1-1 ina 212(d)(3)(a) wAIVERS (CT:VISA-1195; 12-21-2020) INA 212(d)(3)(A) provides for a Department of Homeland Security (DHS) waiver of INA 212(a) ineligibilities (except for INA 212(a)(3)(A)(i)(I), INA 212(a)(3)(A)(ii), INA 212(a)(3)(A)(iii) , INA 212(a)(3)(C), INA 212(a)(3)(E)(i), and INA 212(a)(3)(E)(ii for nonimmigrant visa applicants.
