As of September 12, 2024, two different sets of H-2A forms are being used depending on whether the Farmworker Protection Final Rule has been implemented and not subject to a federal court injunction. For any application that is not a party to the Kansas v. DOL litigation, as explained in OFLC’s September 10, 2024, announcement, field descriptions will refer to “v2” as the form version, while any application that IS a party to the Kansas v. DOL litigation will refer to “v3” as the form version.
